JUDGMENT

By an Originating Motion dated the 13th day of April 2018 and filed on the 16th of April 2018, the Applicant seeks the following reliefs from this Honourable Court:

  1. AN ORDER of this Honourable Court disqualifying Wolfgang Peter from acting as Presiding Arbitrator in the Ad Hoc Arbitration between Esso Exploration and Production Nigeria (Offshore East) Limited, Chevron Petroleum Nigeria Limited, Nexen Petroleum Nigeria Limited and Total E & P Nigeria Limited V. Nigerian National Petroleum Corporation (NNPC) pending before the arbitral tribunal (Coram: Wolfgang Peter, Stephen L. Drymer and A.B. Mahmoud SAN)

 

  1. AN ORDER of this Honourable Court terminating the mandate of Wolfgang Peter, Stephen L. Drymer and A.B. Mahmoud SAN to act as the Arbitral Tribunal in the Ad Hoc Arbitration between Esso Exploration and Production Nigeria (Offshore East) Limited, Chevron Petroleum Nigeria Limited, Nexen Petroleum Nigeria Limited and Total E &P Nigeria Limited V. Nigerian National Petroleum Corporation.

OR

 

  1. AN ORDER setting aside the interlocutory award/decision made by the Arbitral Tribunal (coram: Dr. Wolfgang Peter, Stephen L. Drymer and A.B. Mahmoud, SAN) on 15th February 2018 in the Ad Hoc Arbitration between Esso Exploration and Production Nigeria (Offshore East) Limited, Chevron Petroleum Nigeria Limited, Nexen Petroleum Nigeria limited and Total E & P Nigeria limited v. Nigerian National Petroleum Corporation and remove all the Arbitrators (Dr. Wolfgang Peter, Stephen Drymer and A.B. Mahmoud SAN), on the ground of misconduct.
